THE QURAN
If the husband dies after he had divorced once or twice and while
the wife is still in the waiting period, she gets entitled to inherit
him. She, however, then enters the waiting period which follows
the death of the husband. If the wife dies in the waiting period
and after she has been divorced once or twice, the husband is
entitled to inherit her. If the death of either of them takes place
after the waiting period, the divorce has to be considered as
irrevocable, and the right of inheritance is lost.
13. Suckling
The child's expenses which cover its suckling, clothing, custody
and other needs have to be met by the father if the child has no
money of its own. The maximum period of suckling is two years.
But the period for custody ranges from seven to eleven years.
Legal schools differ with regards to its duration.
14. The Will (
AlWasiyya)
In obedience to Allah the Muslim's bequest must not exceed one
third of his wealth. And a bequest to an heir is illegal.
To be valid, a bequest exceeding one third of the testator's wealth
requires the assent of the heirs even if the bequest is made to one
of them.
Some Muslim jurists regard the will and its execution as
mandatory in certain cases even if no will has been made.
Consequently the jurists of some Muslims countries have agreed
on the bequest of one third for the sons of him who dies during
